These Terms apply to all past, present, and future transactions and interactions with Functional Holistic.

I am Gavin Larsen, a Traditional Chinese Medicine Practitioner (R.TCM.P, Dr. TCM Dip.). 3. NO PRACTITIONER-CLIENT OR THERAPEUTIC RELATIONSHIP

Use of this website, purchase of any product (including personalized reports, custom protocols, or high-touch programs), participation in any program, or receipt of any communication does NOT create:

  • A doctor-patient relationship
  • A practitioner-client relationship
  • A therapeutic or clinical relationship
  • Any duty of care, fiduciary duty, or ongoing obligation

Any information provided — including responses to questionnaires, personalized materials, emails, or 1:1 communications — is for educational and informational purposes only and does not constitute individualized medical care or treatment, regardless of how specific or personalized it may appear.

3A. NO RELIANCE ON INFORMATION

3B. NO DUTY TO MONITOR OR FOLLOW UP

You acknowledge that Functional Holistic has no obligation to monitor your condition, track your progress, check in on your health status, or provide follow-up care of any kind — even within the context of a higher-priced or ongoing program.

You are solely responsible for seeking appropriate medical supervision and ongoing care throughout any engagement with Functional Holistic.

In the event of any health emergency, decline in health, or adverse reaction, you agree to immediately seek qualified emergency or medical care and not rely on Functional Holistic for emergency guidance or support.

4. MANDATORY: CONSULT YOUR HEALTHCARE PROVIDER

YOU MUST CONSULT WITH A QUALIFIED, LICENSED HEALTHCARE PROVIDER BEFORE:

  • Starting any new supplements, herbs, or botanicals
  • Making any dietary changes
  • Beginning any new health or wellness protocol
  • Stopping or changing any current medications
  • Implementing ANY recommendations from our products or services

This requirement is ESPECIALLY CRITICAL if you:

  • Are pregnant, nursing, or planning pregnancy
  • Have any diagnosed medical conditions (thyroid disorders, PCOS, autoimmune conditions, diabetes, cardiovascular disease, hormonal imbalances, etc.)
  • Are taking ANY prescription medications
  • Have food allergies or sensitivities
  • Have a history of eating disorders
  • Are under 18 years of age
  • Have any mental health conditions

FAILURE TO CONSULT YOUR HEALTHCARE PROVIDER IS DONE ENTIRELY AT YOUR OWN RISK.

5. NO GUARANTEES OR WARRANTIES

NO RESULTS ARE GUARANTEED OR PROMISED FOR ANY PRODUCT OR SERVICE.

Every person’s body, genetics, health history, and circumstances are different. While products and services may be personalized based on information you provide:

  • Hair regrowth and/or cessation of hair loss are not guaranteed for hair-related products

7A. INTERPRETATION AND APPLICATION OF INFORMATION

You are solely responsible for how you interpret and apply any information provided by Functional Holistic. Misinterpretation, misuse, or misapplication of information — whether in a digital product, personalized protocol, email, or any other format — does not create any liability for Functional Holistic or Gavin Larsen.

If any information is unclear, you agree to seek clarification before acting on it and to consult your healthcare provider before implementation.

8. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FUNCTIONAL HOLISTIC AND GAVIN LARSEN SHALL NOT BE LIABLE FOR ANY CLAIMS ARISING FROM OR RELATED TO YOUR USE OF THIS WEBSITE OR ANY PRODUCTS OR SERVICES.

This includes but is not limited to:

  • Any adverse reactions to supplements, herbs, dietary recommendations, or wellness protocols
  • Any health outcomes, whether positive, negative, or neutral
  • Any interactions between recommendations and your medications or medical conditions
  • Any injuries, illnesses, or health complications
  • Any direct, indirect, incidental, consequential, special, or punitive damages
  • Lost profits, lost data, loss of business, or loss of opportunity
  • Any claims, demands, or causes of action arising from your use of our products, services, or website
  • Any reliance on information provided

This limitation applies even in cases of alleged negligence, to the maximum extent permitted by applicable law.

Your maximum recovery, if any claim were to succeed despite these Terms, shall not exceed the amount you paid for the specific product or service giving rise to the claim, or $100 CAD if the claim arises from free content or website access.

This limitation applies to all claims based on warranty, contract, tort (including negligence), strict liability, or any other legal theory, and applies even if you have been advised of the possibility of such damages, or if any limited remedy fails of its essential purpose.

9. ASSUMPTION OF RISK

You acknowledge, understand, and voluntarily assume ALL RISKS associated with implementing dietary changes, taking supplements, following wellness recommendations, making lifestyle modifications, and any other actions taken based on our products, services, or website content.

Risks may include but are not limited to: allergic reactions, drug interactions, worsening of existing conditions, development of new health issues, gastrointestinal distress, hormonal changes, lack of improvement, financial loss from purchasing recommended products, and any other unforeseen consequences.

You accept these risks freely and voluntarily.

10. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Functional Holistic, Gavin Larsen, and all affiliated parties, officers, directors, employees, and agents from and against any and all claims, demands, lawsuits, damages, losses, costs, liabilities, and expenses (including reasonable legal fees) that arise from or relate to:

  • Your use or misuse of this website, any product, or any service
  • Your implementation of any recommendations
  • Any health outcomes you experience
  • Your breach of these Terms
  • Your violation of any applicable law or regulation
  • Any negligence or willful misconduct on your part

11. MANDATORY DISPUTE RESOLUTION

Step 1 — Informal Resolution (Required)

Before initiating any formal legal proceeding, you must provide written notice to gavin@functionalholistic.com describing your dispute in detail and the resolution you seek. The parties agree to negotiate in good faith for a period of thirty (30) days from the date of that notice (the “Negotiation Period”). No formal proceeding may be initiated until the Negotiation Period has expired without resolution.

Step 2 — Binding Arbitration

If the dispute is not resolved during the Negotiation Period, it shall be submitted to final and binding arbitration in British Columbia, Canada, under the Arbitration Act, RSBC 1996, c. 55 (as amended). The arbitration shall be conducted by a single arbitrator mutually agreed upon by the parties, or if no agreement is reached within 14 days, appointed by the British Columbia International Commercial Arbitration Centre (BCICAC). The arbitration shall be conducted in English in Vancouver, British Columbia.

The arbitrator shall have authority to award any remedy available at law or equity, but shall NOT have authority to award punitive damages. The arbitrator’s decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

Step 3 — Class Action Waiver

YOU WAIVE ANY RIGHT TO COMMENCE, JOIN, OR PARTICIPATE IN ANY CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING. ALL DISPUTES MUST BE BROUGHT SOLELY ON AN INDIVIDUAL BASIS.

Nothing in this section prevents either party from seeking emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent irreparable harm pending arbitration.

12. NO MEDICAL CLAIMS

We make absolutely no claims that any of our products or services will cure, treat, prevent, or diagnose any disease or medical condition; reverse any health condition; replace medical treatment or medications; or produce any specific outcome for any individual.

IF YOU HAVE OR SUSPECT YOU HAVE A MEDICAL CONDITION, YOU MUST SEE A QUALIFIED HEALTHCARE PROVIDER FOR PROPER DIAGNOSIS AND TREATMENT.

13. ACCURACY AND COMPLETENESS

Recommendations are based solely on information you provide. We cannot verify the accuracy or completeness of your responses. We do not have access to your medical records, lab results, or complete health history. Information may become outdated as research evolves. We are not responsible for errors, omissions, or outdated information.

You should verify all information with your healthcare provider, research all recommendations independently, and seek current medical advice for your specific situation.

13A. EVOLVING INFORMATION AND SCIENCE

Health and wellness information is constantly evolving. Scientific understanding of nutrition, supplementation, and holistic health changes over time, and what is considered best practice today may be revised or contradicted by future research.

You acknowledge that recommendations may become outdated after the time of delivery, and that Functional Holistic is under no obligation to update, revise, or notify you of changes to previously provided materials, protocols, or recommendations.

You assume full responsibility for verifying the currency and accuracy of any recommendations with your healthcare provider before and during implementation.

14. DIGITAL PRODUCTS — REFUND POLICY

Refunds are granted at our sole discretion and apply only to concerns about the quality or accessibility of the product, not to results, health outcomes, or dissatisfaction with recommendations.

To request a refund, you must contact us at gavin@functionalholistic.com within 60 days of purchase and demonstrate that you made a reasonable, good-faith effort to engage with the material before determining it does not meet the described standard of quality.

We reserve the right to deny refund requests that appear abusive, fraudulent, made in bad faith, or inconsistent with the intent of this policy. Refund abuse, including initiating chargebacks without first contacting us, constitutes a breach of these Terms and may result in recovery of costs.

For high-ticket and custom programs, separate refund terms are set out in the Client Agreement applicable to that engagement, which governs in the event of any conflict with this section.

15. INTELLECTUAL PROPERTY

All products, services, content, and materials are protected by copyright and applicable intellectual property laws. You may use purchased products for your own personal health and wellness only. You may not share, copy, distribute, post online, use commercially, modify, create derivative works from, or resell any products or content. Violation may result in immediate termination of access and legal action.

16. PRIVACY AND DATA USE

We collect and use your information to provide products and services. By purchasing or using this website, you consent to collection of name, email, and purchase information; use of intake responses to personalize recommendations; and email communication about your purchase and account. 17. TESTIMONIALS AND RESULTS

Testimonials and success stories represent individual experiences and are not guarantees of results. Results shown are not typical. Your results may vary significantly. We do not verify health claims made in testimonials. Past results do not predict future outcomes.

18. THIRD-PARTY PRODUCTS AND AFFILIATE LINKS

We may recommend third-party products, supplements, or services. We are not responsible for third-party products, their quality, safety, or effectiveness. 19. GOVERNING LAW AND JURISDICTION

These Terms are governed by the laws of British Columbia, Canada, and the federal laws of Canada applicable therein, without regard to conflict of law principles. Subject to the mandatory arbitration provision above, any dispute that proceeds to court shall be resolved exclusively in the courts of British Columbia, Canada, and you hereby consent to personal jurisdiction in those courts.

20. SEVERABILITY

If any provision of these Terms is found invalid or unenforceable by a court or arbitrator of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if it cannot be modified, and the remaining provisions shall continue in full force and effect.

21. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy and any applicable Client Agreement, constitute the entire agreement between you and Functional Holistic regarding your use of this website and any products or services, and supersede all prior understandings, agreements, representations, and warranties. In the event of any conflict between these Terms and a signed Client Agreement, the Client Agreement governs with respect to that specific engagement.

22. CHANGES TO THESE TERMS

We reserve the right to modify these Terms at any time. Changes are effective immediately upon posting to functionalholistic.com. Your continued use of the website or any products or services after changes are posted constitutes your acceptance of the revised Terms. Material changes will be communicated via email where practicable.
